Barangay Ermitaño E-Barangay Management System

1 INTRODUCTION

In compliance with Republic Act No. 10173, otherwise known as the Data Privacy Act of 2012 (DPA), and its Implementing Rules and Regulations (IRR), Barangay Ermitaño is committed to protecting the privacy, confidentiality, and security of your personal data. This document outlines how we collect, use, share, and protect your information within the E-Barangay Management System.

2 SCOPE OF DATA COLLECTION

By registering an account and profiling your household in the E-Barangay System, you authorize Barangay Ermitaño to collect personal and sensitive personal information, which includes but is not limited to:

Personal Identifiers: Full Name, Date of Birth, Age, Sex, Civil Status, and Place of Birth.
Contact Details: Residential Address, Email Address, and Mobile/Telephone Numbers.
Socioeconomic Data: Educational Attainment, Employment Status, Monthly Income Bracket, and Household Composition.
Sensitive Information: Health/Disability Status (e.g., PWD, Senior Citizen), Voter Status, and Government-issued ID details used for verification.

3 PURPOSE OF DATA PROCESSING

The personal data collected will be strictly utilized for legitimate local government purposes, specifically:

Registry of Barangay Inhabitants (RBI): Establishing and maintaining an accurate demographic profile of the barangay.
Public Services & Issuances: Processing and verifying requests for Barangay Clearances, Certificates of Indigency, Business Permits, and other official documents.
Social Welfare & Programs: Identifying eligible beneficiaries for government aid, health programs, and social amelioration initiatives.
Peace and Order: Documentation of complaints, blotters, and emergency response management.

4 DATA SHARING AND DISCLOSURE

Barangay Ermitaño treats your personal data with strict confidentiality. Your information will NOT be sold, traded, or shared with unauthorized private third parties. However, we may disclose your data to:

Higher Local Government Units (City/Municipal Government).
National Government Agencies (e.g., DILG, DSWD, PSA) as mandated by law.
Law enforcement agencies (e.g., PNP) upon lawful order or in the interest of public safety and order.

5 DATA RETENTION AND SECURITY

Your data is stored securely in the E-Barangay digital database with restricted access limited only to authorized barangay personnel. Personal data will be retained only for as long as you are a resident of Barangay Ermitaño, or as required by the archival laws of the National Archives of the Philippines, after which it will be securely disposed of.

6 RIGHTS OF THE DATA SUBJECT

Under the DPA of 2012, you are entitled to the following rights:

Be informed.
Access your data.
Object to processing.
Dispute and rectify errors.
Suspend, withdraw, or order blocking/removal.

7 CONSENT DECLARATION

"By proceeding with the registration, I hereby affirm that I have read and completely understood the terms outlined in this Data Privacy Statement. I freely give my explicit consent to Barangay Ermitaño to collect, process, store, and share my personal data strictly for the purposes stated above, in accordance with the Data Privacy Act of 2012."

Terms & Conditions

1. Acceptance of Terms

By using the Barangay Management System, you agree to follow these Terms and Conditions. If you do not agree, you should not use the system.

2. Use of the System

Users are expected to use the system only for legitimate barangay-related transactions such as requesting documents, submitting complaints, and accessing personal records. Any misuse of the system is strictly prohibited.

3. User Responsibilities

Users must provide accurate and complete information when using the system. They are responsible for maintaining the confidentiality of their account and login credentials.

4. Prohibited Activities

Users must not engage in activities that may harm the system, including unauthorized access, data manipulation, or attempting to disrupt system operations.

5. System Availability

The Barangay Management System aims to be available at all times; however, temporary interruptions may occur due to maintenance, updates, or technical issues.

6. Limitation of Liability

Barangay Ermitano shall not be held liable for any damages or losses resulting from the use or inability to use the system, including system errors or delays.

7. Privacy and Data Protection

All personal data provided in the system is protected under the Privacy Policy and in accordance with the Data Privacy Act of 2012 (RA 10173).

8. Modification of Terms

Barangay Ermitano reserves the right to modify these Terms and Conditions at any time. Users will be informed of significant changes when necessary.

9. Termination of Access

The barangay reserves the right to suspend or terminate access to users who violate these Terms and Conditions.

10. Governing Law

These Terms and Conditions are governed by the laws of the Republic of the Philippines.

Barangay Ermitano is not responsible for any problems, losses, or damages that may occur from using the system. This includes, but is not limited to, incorrect information, system errors, or interruptions in service.

Users are responsible for providing correct and truthful information. For important or official transactions, users should double-check information directly with the Barangay Ermitano office.

The system may be temporarily unavailable for maintenance or updates without prior notice. We do not guarantee that the system will always be working without interruption.
